Preparing Clients for Discussing and Negotiating Settlement Options

Before clients should begin to engage in settlement discussions and explore their options they need to prepare.  Preparation not only will allow them to make better decisions, but they will be more confident in their negotiations if they believe they have the mindset and the tools to make wise decisions.  Fearful, uninformed clients not only make poor decisions, but they are afraid to make them.  Terri will discuss the tools that she incorporates in her mediation practice to empower her clients to make their own decisions, including fostering a cooperative mindset, information gathering, providing legal information, collaborating with other professionals when needed, using form judgment and settlement templates to help clients craft their settlement terms and preparing herself before every mediation session to successfully facilitate the decision-making process.

Attorney and Mediator, Terri Breer, has been a licensed attorney since 1985 and has experience as a civil litigator, mediator and collaborative attorney handling divorce, family law, real estate, and business matters. Although she has conducted civil trials involving business, real estate and family law disputes, her practice has been devoted to mediation of family law disputes and other forms of alternative dispute resolution including collaborative divorce methods.

Ms. Breer owned and managed Breer Law Offices for over 30 years.  Her private practice was established first in 1988 as a civil litigation firm focusing on family law, real estate, and business matters.  In 1994 the firm expanded to include family law mediation and in 2004, Collaborative Divorce.  She has mediated hundreds of family law disputes, including divorce, custody, property division, pre-marital agreements, domestic partnerships, and surrogacy arrangements.  Ms. Breer will often use a cooperative team approach when she mediates divorce disputes collaborating with financial planners, child specialists and divorce coaches through the mediation process.

In 2019 she formed New Day Divorce Center, Inc. where she continues to provide divorce mediation services.  In addition, Ms. Breer is an MCLE provider for the State Bar of California and provides Family Mediation Training for California attorneys, therapists, financial professionals, and mediators through her business, New Day Divorce.  Her training curriculum focuses on her 5-Step System for California Divorce that provides both attorney and non-attorney  family mediators the essential tools they need to competently handle the mediated divorce, including characterization and division of marital property, determining child and spousal support, creating parenting plans, and preparing and processing uncontested divorces in California jurisdictions.

She has written several articles on alternative dispute resolution and the need for change in the current family law adversarial system.  She was Chair of OCBA – Alternative Dispute Resolution Section in 2014.  She has served as Board Member of the Southern California Mediation Association (SCMA) for two terms from 2015 to 2021.   She has led SCMA’s Orange County Professional Development Group and has chaired the SCMA Family Mediation Institute (FMI) for six years from 2018 to 2023.  In 2019 she received the SCMA’s President’s Award for Exceptional Service and in 2023 she was awarded the Forrest “Woody” Mosten SCMA Star Award for Excellence & Innovation in Family Mediation.  She has presented numerous workshops and presentations for the OCBA and LA Bar Association, the Association of Family Conciliation Courts (AFCC), Southern California Mediation Association (SCMA), International Association of Collaborative Professionals (IACP), Collaborative Practice of California (CPCal), Family Mediation Institute (FMI) and the Academy of Professional Family Mediators (APFM).

Ms. Breer is active in hosting various networking and educational opportunities for divorce professionals, including South Coast Collaborative Professionals Luncheons and Mixers from 2006 to 2016, and The Attorney Therapist Breakfast Club that was founded in 2017 that meets monthly in Orange County.  Both professional groups bring together professionals who share their commitment to help families cooperatively and consensually resolve divorce and family law disputes outside the adversarial court system.
